1. Purpose

These terms of use (the “Terms”) govern the use of the Nautilo app (the “App”) and its in-app purchase, The Whole Cove, on iPhone and iPad as well as on Android. By downloading or using the App, you accept these Terms. They supplement the terms of the store you downloaded the App from, which also apply:

  • On iPhone and iPad: Apple’s standard Licensed Application End User License Agreement.
  • On Android: the Google Play Terms of Service, which govern your use of Google Play and your purchases. The licence to use the App is the one in section 6 of these Terms.

2. Publisher

Helby Studio, SASU registered in Paris under number 928 684 323, 61 rue de Lyon, 75012 Paris, France. Contact: hello@helby.studio.

3. The App

Nautilo is a listening memory game for children aged 3 to 8, available on iPhone and iPad (iOS 17 or later) and on Android phones and tablets (Android 8.0 or later). Downloading is free and includes a demo game that can be replayed without limit. Other content (levels, songs, jukebox) is unlocked by a single in-app purchase, The Whole Cove.

The App is meant to be used by children under the responsibility of an adult. Purchases are made with the device’s Apple or Google account, under the responsibility of the adult who owns it; the grown-ups’ area and purchases are protected by a check young children cannot solve.

4. The Whole Cove purchase

  • What it is: a single, non-consumable in-app purchase. It unlocks all 12 levels, all 32 songs and the Big Conch of the App, with no time limit. It is not a subscription: there is no trial, no renewal and nothing to cancel.
  • Price: shown in the App and on the store (App Store or Google Play) before any purchase, including applicable taxes in your country. A reduced price may occasionally be offered, for example at launch.
  • One purchase per store: the App Store and Google Play each sell their own purchase. A purchase made on the App Store does not unlock the App on Android, and vice versa.

On iPhone and iPad (App Store)

  • Sale and payment: the purchase is made with Apple, which sells it through the App Store, charges and invoices it under its own terms. It is charged once to your Apple Account when you confirm the purchase. Helby Studio never receives any payment data.
  • Family Sharing: the purchase is shared with the members of your Family Sharing group.
  • Restoring: the purchase can be restored at any time, on a new device or after reinstalling, from the grown-ups’ area (“Restore purchases”), with the same Apple Account.

On Android (Google Play)

  • Sale and payment: the purchase is made with Google, which sells it through Google Play, charges and invoices it under its own terms. It is charged once to the payment method of your Google Play account when you confirm the purchase. Helby Studio never receives any payment data.
  • Pending purchases: if you pay with a delayed payment method offered by Google Play, or if the purchase needs a parent’s approval (Google Family Link), the content is unlocked as soon as Google confirms the payment.
  • Account: the purchase is tied to the Google account that made it. Google Play Family Library does not cover in-app purchases.
  • Restoring: the purchase can be restored at any time, on a new device or after reinstalling, from the grown-ups’ area (“Restore purchases”), with the same Google account.

5. Refunds

Purchases are made with Apple or Google and subject to their terms.

On iPhone and iPad (App Store)

Refund requests are handled by Apple at reportaproblem.apple.com.

On Android (Google Play)

Within 48 hours of the purchase, you can ask Google for a refund directly from your Google Play order history, under Google Play’s refund policies. After that, email us at hello@helby.studio with the order number (it starts with “GPA.”): we look at every request and, if we accept it, the refund is made by Google Play to your payment method.

6. Intellectual property

The App, its name, its world (Bernie, Echo Cove), its illustrations, musical arrangements, recordings and sounds belong to Helby Studio and are protected by copyright. The nursery rhyme melodies are traditional and in the public domain; their arrangements and orchestrations are original works by Helby Studio. You are granted a personal, non-exclusive, non-commercial right to use the App. Copying or extracting its content is prohibited.

7. Availability and updates

We do our best to keep the App working well and we keep improving it. Some features may change; the content unlocked by the purchase remains available. The App works offline; a connection is only needed to purchase or restore it through the App Store or Google Play.

8. Liability

Nautilo is a game. It is not meant to replace music lessons or medical or speech therapy. We recommend age-appropriate screen time; a break reminder can be set in the grown-ups’ area. Helby Studio is not liable for misuse of the device or for interruptions caused by Apple, Google or the network.

9. Personal data

Nautilo collects no data: purchases are handled by Apple or Google and progress stays on the device. See our privacy policy.

10. Changes to these Terms

We may update these Terms. The current version is always published on this page with its date, and significant changes will be announced in the App.

11. Governing law

These Terms are governed by French law, without prejudice to the mandatory consumer protection rules of your country of residence. If you have a problem with the App, please write to us first at hello@helby.studio so we can find a solution together. For payment, billing or refund questions, please contact the store that sold the in-app purchase: Apple (reportaproblem.apple.com) or Google (see section 5).
